Think again.

Let's dive into what a knockout trademark search means for someone looking for a Mississippi trademark lawyer or Louisiana trademark lawyer. Spoiler alert: federal trademarks are nationally regulated so you can use a lawyer licensed in any state (but don't you want a local so they can handle your contracts, licensing agreements, and all the other paperwork that comes with a business?)

What Is a Trademark Clearance Search?

Before you start a Louisiana trademark registration, back up.

You need to focus on a trademark availability search Louisiana first.

This is where you perform what is known as a "knockout trademark search" or "trademark clearance search".

  • You use good ol' Google using the name you want to use. Just because it's a business name available in your state doesn't mean it's not federally trademarked. No one is going around policing the Louisiana Secretary of State website (unless you're me and you're my client; sorry not sorry!). That means folx can just register names willy nilly...until they "get got". We will go over that further down.
  • You check social media handles. Is anyone using it? Good. Don't use it. "But Amber it's a different category than what I do"--- but IS IT? There was about 50 international trademark classes.
  • You do a search with every Secretary of State (or Corporate Division) in each state. Is your name registered to someone else? Would it compete with you? This is called common law use, baby. It has some teeth to it if y'all start popping off at a federal level.
  • You do a search internationally. Don't worry- I'm a member of the International Trademark Association. We can do this in our sleep. Figuratively speaking.
  • You search the United States Patent and Trademark Office for your name. Don't forget- they use Boolean codes. You need to also check for phonetic spellings and things that sound like your name too. This includes foreign translations.

Now, you need to analyze your findings based on current case law on a state and federal level.

When Should I Do a Trademark Search for My Business?

In a perfect world, before you even form your business with the secretary of state or roll out your new products.

In a not so perfect world, now.

Or when you:

  • Want to expand your market
  • Want to franchise
  • Need to license
  • Gain a large social media following (this means more attention on you; heavy is the crown amirite?)
  • Want to sell the brand
  • Want to bring in new partners or members
  • Launch a new logo or rebrand
  • Create a book, even an e-book

There's no wrong way to eat a Reese's, but there is a wrong way to protect your business and property.

Why Is a Louisiana Trademark Search Important?

When you use someone else's federally (or internationally) protected trademark, then you are committing trademark infringement. Just by being registered with the USPTO, you put everyone in the whole wide world (kind of) on notice you own it. Even if they don't actually know you do and haven't looked at the database. They have an obligation to check that out first.

That's why the knockout clearance search is important, even for Louisiana small businesses.

Before you start Googling "trademark infringement lawyer Louisiana", hang on a second.

What steps would the other person take if they think you are infringing on their name?

  • You will get a cease-and-desist letter asking you to, essentially, "stop it".
  • If you do not stop using it, or enter into a license agreement/settlement agreement with the folx who own it, then they will sue you in federal court.
  • Federal court is not fun.
  • If they win, you will have to pay: attorney's fees, court costs (including expert fees), and damages. Damages includes lost profits.
  • You have to destroy your inventory. Bye bye money.
  • You have to turn over profit you made from using their trademarked name.

Not to mention the years long legal battles you have to go through, plus a rebrand, all because you didn't do a "quick" (in the grand scheme of things) Louisiana trademark availability search.

What Do I Do If Someone Else Has My Name in a Trademark Search?

Just because someone has your name, doesn't mean you can't use it if consumers would not be confused by the two businesses. For example, if Tubbs' Club sells dog treats, but Tubbs Clubs sells golf clubs, then consumers may not confuse the two. That's never a guarantee and it's why analyzing case law, TTAB decisions, and current markets by a lawyer is important.
